INFORMATION REGARDING THE PROTECTION OF PERSONAL DATA PURSUANT TO ARTICLE 13 OF LEGISLATIVE DECREE NO. 196 OF 30 JUNE 2003 FOR CANDIDATES SENDING CVs TO THE COMPANY.
In compliance with the provisions of Article 13 of the Legislative Decree no. 196 dated 30 June 2003, by this notice, the company Emilio Pucci S.r.l. ("the Company") with its Registered Office in Florence at Via De Pucci 6, in its capacity as Data Controller of data processing in the person of its Legal Representative, wishes to inform candidates sending their unsolicited Curriculum Vitae ("the Candidate(s)") of the purposes of the processing of the personal data so collected and the extent to which the personal data will be communicated to others together with the nature of the processing.
Personal data received by means of the unsolicited sending of CVs by E-mail are collected and processed directly for recruitment and selection, in full observance of the principles of propriety and the applicable law.
The collection will only regard common data and as such, the Candidate should not indicate sensitive data such as defined by Article 4 of Legislative Decree 196/2003, that is, "personal data capable of revealing racial and ethnic origins, religious, philosophical or other beliefs, political opinions, membership of parties, trade unions, associations or organisations of a religious, philosophical, political or trade union nature as well as personal data capable of revealing the person's state of health or sexual orientation".
The data processing will be effected by means of computer-based procedures, through telematic and/or paper means and by persons specifically appointed by the Company for the purpose whether internal or external to the Company. The data may be stored on paper, computerised and/or archived online for a period not exceeding two years. After that period the data concerned will be deleted and/or destroyed as the case may be.
The Candidate is entitled to enforce his/her rights as laid down in Articles 7, 8, 9 and 10 of the Legislative Decree no. 196 dated 30 June 2003 by contacting the Company. According to the provisions of Article 7, the Candidate has the right to obtain confirmation of the existence or otherwise of his/her personal data, even when not yet recorded and may request the communication of the same in an intelligible form. The Candidate has the right to obtain an indication of the following: a) the origin of the personal data; b) the purpose and procedure of the processing; c) the logic applied in the case of processing effected with the assistance of electronic equipment; d) details identifying the Data Controller, the Data Processor and the representative appointed pursuant to Article 5, paragraph 2; e) those parties or categories of parties to which such personal data may be communicated or to whom the personal data may become known in the capacity of designated representative in Italy, of Data Processor and/or assistant to the Data processor.
The Candidate will have the right to require the following: a) the updating, correction or, when it is in his/her interest, the supplementing of the data; b) the deletion, transformation into anonymous form or the blocking of the data processed in breach of the law including those which do not need to be preserved to achieve the purpose for which they were collected or subsequently processed; c) a statement that those to whom the data have been communicated or disseminated have been informed that the operations described under letters a) and b), including with regard to their content, have been performed save where such an obligation proves to be impossible or requires an expenditure of resources which is manifestly disproportionate to the right to be protected.
The Candidate have the right to oppose all or part of the following: a) the processing of his/her personal data on legitimate grounds even when relevant to the purpose of the collection; b) the processing of his/her personal data effected for the purpose of sending out advertising material, direct sales, the conduct of market research or commercial communications.
